Equal Employment Opportunity (EEO) and Non‑Discrimination Policy
Equal Employment Opportunity Statement
Both Keller and its clients are Equal Opportunity Employers in Mexico. All employment decisions—without exception—are made without discrimination based on ethnic or national origin, color, culture, sex, gender, gender identity or expression, sexual orientation, age, disability, social or economic condition, health status (including pregnancy and lactation), religion, language, opinions, marital or family status, migration status, political affiliation, or any other status protected by law. This commitment reflects the Federal Constitution’s non‑discrimination principle and the following laws: the Federal Labor Law (LFT) and the Federal Law to Prevent and Eliminate Discrimination (LFPED); and, in Mexico City, the Law to Prevent and Eliminate Discrimination of Mexico City.
Scope. This policy applies to every stage and aspect of employment, including recruiting, hiring, assignment, compensation, benefits, training, promotion, transfer, leave, discipline, termination, and all workplace programs. The LFT prohibits employment conditions that discriminate and defines workplace harassment and sexual harassment, which this policy expressly forbids.
Commitment to Diversity, Equity & Inclusion
Keller and its clients foster diverse, inclusive, and safe workplaces where everyone is valued and can thrive. This commitment aligns with the LFPED (federal) and CDMX anti‑discrimination law, which promote equal opportunity and actions to prevent and eliminate discrimination.
We also recognize the LGAMVLV framework to prevent, address, and eradicate violence against women, including violence in the workplace and educational settings, and we support measures that ensure a work environment free from violence for all employees.
Reasonable Accommodations ( Ajustes Razonables )
Keller and its clients will provide reasonable accommodations ( ajustes razonables) to qualified individuals with disabilities, pregnant and lactating employees, and others as required by law, through an interactive process to identify effective accommodations that enable equal access to employment and job performance. This is consistent with LFPED definitions of _ajustes razonables_ and LFT protections for dignified work and non‑discrimination.
Harassment‑ and Violence‑Free Workplace
We strictly prohibit all forms of workplace harassment, including hostigamiento (abuse of power in a hierarchical relationship) and acoso sexual (sexual harassment without hierarchy), and any conduct that creates a hostile, intimidating, or offensive environment. The LFT defines these concepts and forbids such conduct by employers and workers. The LGAMVLV also requires measures to prevent, address, and sanction workplace violence.
Psychosocial risk prevention. In line with NOM‑035‑STPS‑2018, we implement and maintain written policies, preventive actions, reporting channels, and follow‑up procedures to identify, analyze, and mitigate psychosocial risk factors and workplace violence, and to promote a favorable organizational environment.
Telework protections. Where telework applies, we comply with NOM‑037‑STPS‑2023 by maintaining a telework policy, ensuring health and safety conditions at the remote workplace, providing necessary equipment and training, and enabling reversibility when justified.
Equal Pay and Fair Compensation
Compensation decisions are based on skills, responsibilities, performance, experience, and market data. Paying a worker less because of age, sex, nationality, or other protected characteristics is prohibited under the LFT. Where we choose to publish salary ranges in job postings, we will ensure that such disclosures are accurate and non‑discriminatory and that final offers reflect bona fide factors such as experience, competencies, internal equity, and applicable pay structures.
Transparency & audits. Keller and its clients periodically review compensation practices to support pay equity and to ensure compliance with applicable federal and local laws and standards.
Data Privacy and Employee Information
We collect and process personal data (including any sensitive data) only for legitimate purposes related to employment and in accordance with the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and its regulations. We provide privacy notices, implement appropriate security, access, and retention controls, and obtain consents where required.
Reporting, Investigation, and Non‑Retaliation
Employees, candidates, contractors, and other stakeholders may report concerns (discrimination, harassment, retaliation, or policy violations) via designated reporting channels (HR, Ethics/Compliance, or the hotline/email provided in local onboarding materials). Reports will be addressed promptly, impartially, and confidentially, consistent with due process and CONAPRED/LFPED anti‑discrimination principles and applicable labor procedures. Retaliation is prohibited.
Local Compliance (Mexico City)
In Mexico City, this policy is further guided by the Law to Prevent and Eliminate Discrimination of Mexico City, including its 2024 updates, and by relevant provisions of the Constitution of Mexico City that reinforce equality and non‑discrimination.
Training and Communication
Keller and its clients provide periodic training on non‑discrimination, harassment prevention, psychosocial risk factors (NOM‑035), and telework obligations (where applicable, NOM‑037). Policies and procedures are made available in Spanish and English for accessibility and understanding.
Administration, Review, and Amendments
This policy is administered by Human Resources and Legal/Compliance in Mexico. It will be reviewed at least annually and updated as laws evolve (e.g., LFT, LFPED, LFPDPPP, LGAMVLV, NOM‑035, NOM‑037) and as internal practices improve.
Note: This job posting may be for a position with Keller Executive Search or one of our clients. The specific employer will be identified during the application and interview process. Employment laws and requirements may vary depending on the employer and location.
