The Corporate Counsel, Collections and Recovery will serve as the in-house legal expert overseeing Mulligan Funding’s collection and recovery activities. Reporting to the Chief Credit Officer, this role provides legal direction, manages litigation efforts, and negotiates directly with delinquent corporate clients to resolve outstanding obligations.

This position plays a key role in driving recovery outcomes while ensuring strict compliance with all applicable laws and maintaining professional relationships with clients. The ideal candidate combines deep legal knowledge with business acumen, strong negotiation skills, and a practical understanding of corporate debt recovery.

You will:

  • Provide legal oversight of all collection and recovery activities across the organization
  • Ensure compliance with federal, state, and local regulations, including the FDCPA, UCC, and relevant statutes
  • Advise on risk mitigation strategies and legal considerations tied to collections practices
  • Engage directly with delinquent corporate clients to understand financial situations and negotiate enforceable repayment plans
  • Leverage legal tools such as demand letters and settlement agreements to facilitate recoveries
  • Maintain professional client relationships while advocating for company interests in repayment terms
  • Initiate and manage legal proceedings as needed, including preparing and filing lawsuits, pursuing judgments, and overseeing legal recovery processes
  • Coordinate with outside counsel and collection agencies to align on litigation strategy and execution
  • Advise leadership on potential legal outcomes, risks, and appropriate courses of action
  • Draft and review legal documents, including contracts, settlements, and legal notices related to collections and recovery
  • Maintain accurate and compliant records of legal activities and documentation
  • Collaborate with internal teams including Finance and Accounting to align on outstanding debt priorities
  • Provide regular updates to senior management on legal actions, litigation status, and recovery performance
  • Stay current on changes to debt collection laws, industry trends, and legal precedents that may impact recovery operations
  • Recommend legal process improvements and contribute to overall collections strategy development

You have:

  • Juris Doctor (JD) from an accredited law school
  • Active license to practice law in Utah or be able to in a reasonable time
  • 10+ years of experience in corporate collections, debt recovery, or commercial litigation, with a focus on negotiation and enforcement
  • Strong understanding of corporate finance, business law, and debt recovery laws
  • Proven ability to manage complex collections and legal negotiations in a business environment
  • Excellent written and verbal communication skills, with the ability to negotiate firmly while maintaining professionalism
  • Strong organizational and case management skills, with the ability to handle multiple legal matters simultaneously
  • Ability to work independently and collaboratively in a fast-paced, results-oriented environment

You may also have:

  • Experience working in a corporate in-house legal department or advising large corporate clients
  • Familiarity with international debt recovery processes
  • Expertise in drafting and managing complex legal documents including settlements, judgments, and notices

$230,000 - $264,150 a year

A reasonable estimate of the salary range for this role is $230,000 to $264,150 per year plus any annual incentives. In order to provide a competitive compensation package, Mulligan Funding takes into account a variety of factors including but not limited to market compensation data, relevant experience, skills, education, and certifications.
